For over 22 years, respecting and protecting the privacy of its clients and their customers has been vital to Credit Infonet's business. Credit Infonet has created this privacy and terms of service statement in order to demonstrate its commitment to privacy, as well as to help explain how client and customer data is kept secure.
Credit Infonet is an Iowa Corporation providing mortgage fulfillment services to mortgage lenders, brokers, banking institutions and secondary market agencies throughout the United States. Credit Infonet collects information necessary in the production of mortgage fulfillment products and services only, and does not disclose such information to third parties.
Credit Infonet is regulated by the Fair Credit Reporting Act, the Gramm Leach Act, and other State Laws, and does not disclose to any third party or organization, information of matters concerning its clients or their customers unless such information is already in the public domain. Credit Reporting information is solely disclosed in accordance with permissible purposes as outlined in the Fair Credit Reporting Act.
Credit Infonet employs both physical and electronic security measures to safeguard the privacy of information collected in the course of providing mortgage fulfillment services. Electronic and physical access to client and consumer information is limited to employees whom require such information in the course of fulfilling their work responsibilities. Security features such as firewalls, users names & passwords, security audits and disaster recovery procedures are further put in place to restrict information to authorized parties only.
Credit Infonet's Online Services employ the following security measures to protect privacy of data stored within the network:
- 128 bit SSL Encryption
- Secure User Names & Passwords to authenticate users accessing the system
- Credit Infonet's network and systems are protected by a TrueSecure Certified Firewall
- Client IP addresses are tracked to diagnose problems and potential system abuse. IP addresses are not used to identify clients and are not linked to client account or access information
- Credit Infonet does not authorize the scanning of its network systems or attempted penetration testing of any degree without the written consent of management.
Terms of Service Specific to Lenders Accessing Credit Infonet's Systems.
The following are the terms and conditions for use of Credit Infonet Online (the "Service"), Credit Infonet's online customer service and transaction management platform. Credit Infonet Online is utilized solely for the ordering of mortgage information products and services including, but not limited to, credit reporting products, flood zone determinations, closing, valuation, title, disbursement and recordation services. This Service is provided for the benefit of Credit Infonet customers whom have executed valid contracts for the ordering of mortgage information services.
The Service is offered to users on their acceptance without modification of the terms, conditions, and notices contained herein.
1. Lender Client Codes, User Names and Passwords
Lenders utilizing the service have been provided with client codes, user names and passwords for accessing the Service securely. As outlined within Credit Infonet's Privacy Statement, Credit Infonet agrees to safeguard all such information provided to the Lender. The Lender shall also agree to the same standards of safeguarding this information as provided by Credit Infonet. The Lender further agrees to notify Credit Infonet of any changes in personnel or staffing that requires a modification in the information provided to access the service. In the event that the Lender detects unauthorized usage, it is its responsibility to immediately notify Credit Infonet of the detected unauthorized use. In the event that Credit Infonet detects any possible unauthorized usage through internal auditing or other security measures it will immediately notify the Lender of such usage.
2. Indemnification
System users agree to indemnify and hold Credit Infonet, its parents, subsidiaries, affiliates, strategic partners, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, arising out of use of the service.
3. Termination by Credit Infonet
Credit Infonet may suspend access to any part, or all of the service, and any related service(s), at any time, with or without cause, with or without notice, effective immediately, for any reason whatsoever.
4. Modifications to Terms of Service
Credit Infonet reserves the right to modify its terms of service at ant time. Such changes will be updated and posted to the Credit Infonet web site as a modification. A user's continued use of the system following the updating of the terns of service shall be viewed as the user's consent and agreement to said changes.
5. General
The laws of the State of Ohio and the United States of America govern this agreement. Use of the service is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. Users agree that no joint venture, partnership, employment, or agency relationship exists between them and Credit Infonet as a result of this agreement. This agreement is to be used in conjunction with additional Credit Infonet agreements that may include, but are not limited to; a master product and service agreement, an application for service, an onsite inspection list, and an Internet usage policy addendum.
